According to CNN reports, on September 10th local time, FTX founder Sam Bankman-Fried submitted a request to the U.S. Supreme Court to overturn his fraud conviction and have the $11 billion fine revoked. Bankman-Fried’s legal team is led by Alexandra A.E. Shapiro from the law firm Shapiro, Arato, Bach. Currently, Bankman-Fried is serving a 25-year prison sentence. The application focuses on two key legal issues: First, under what circumstances can lower courts accept evidence proving whether victims suffered financial losses, especially when the prosecution uses the theory of “fraudulent inducement”? Second, does the Eighth Amendment to the U.S. Constitution allow fines that could permanently ruin a defendant’s ability to earn a living in the future?
