OKX is not a scam: a top-three derivatives exchange with monthly proof of reserves (zk-STARK, Hacken-audited), EU MiCA plus Dubai VARA and Singapore M…

The short answer: OKX works, but there is a $505 million line on its record

Straight answer: OKX is not a scam, and it is not an unregulated offshore shell. It is a top-three derivatives exchange, publishes monthly proof of reserves, holds a full EU MiCA licence, and has never had its exchange wallets breached since 2022. But its record carries one scar you need to know about: in February 2025 OKX's Seychelles operating entity, Aux Cayes FinTech, pleaded guilty in the United States to operating an unlicensed money transmitting business and violating AML law, paying roughly $505 million in total (about $420.3 million in forfeiture plus roughly $84.4 million in criminal fines), and agreeing to an external compliance monitor through February 2027.

Three points up front:

  • The money went to US regulators as a penalty — it was not a user-funds failure. No user assets were misappropriated and none were stolen;
  • OKX's stain is about compliance (it knowingly served US customers for seven years), not about asset security;
  • After the penalty it moved to a licensed path: Malta MiCA, Dubai VARA and Singapore MAS licences followed, and the US platform relaunched under a separate licensed entity.

Who it suits: advanced users who want futures, options and a Web3 wallet in one app. Who it does not: newcomers hunting zero-fee spot trading, and anyone who wants a spotless compliance record.

What OKX actually is

OKX began life as OKEx in 2017 and rebranded to OKX in January 2022. The founder is Star Xu. The global platform is operated by Aux Cayes FinTech Co. Ltd., registered in the Seychelles — the same entity named in the US settlement.

Security record: the exchange was never breached, but compliance was

First, the breach history. From 2017 to October 2026, OKX has had no publicly reported incident where an exchange hot wallet was breached and user assets were lost. That is a hard benchmark among top-tier venues: over the same period FTX misappropriated client funds, Bybit lost $1.46 billion to a hack, and HTX was breached twice. OKX's exchange-side security record is clean.

Now the compliance case — the real blemish. According to the US Department of Justice, from 2018 to early 2024 OKX served US retail and institutional customers even though it had adopted an internal policy against doing so in 2017. In February 2025 the operating entity pleaded guilty in a New York federal court to one count of operating an unlicensed money transmitting business, paying roughly $505 million in total — about $420.3 million in forfeiture and about $84.4 million in criminal fines. Keep the nature straight: this is a regulatory penalty, not insolvency, not misappropriated client money, and not a hack.

After the settlement OKX followed Binance's playbook — plead, pay, then go licensed. In April 2025 it relaunched in the US under a separate entity with a new CEO, and it filled in licences across Europe, the Middle East and Singapore through 2025–2026 (see the next section).

There is also a boundary that is not the exchange's responsibility but is yours to hold: in December 2025 CEO Star Xu publicly warned about DEX bot products that upload users' private keys to servers, after a roughly $255,000 theft. On-chain approvals, seed phrases and third-party bots are not covered by exchange custody — do not blur the two.

Proof of reserves: monthly, self-verifiable — with two caveats

After the November 2022 FTX collapse, OKX was among the first exchanges to publish Merkle-tree proof of reserves, and it upgraded the Merkle tree to a zk-STARK scheme (avoiding negative-node and trusted-setup risks), with open-source verification code and a monthly audit by the security firm Hacken. As of March 2026 it had published 41-plus consecutive reports covering 22 major assets including BTC, ETH, USDT and USDC, with reserves consistently above 100%; users can independently confirm that their own balance was included in the snapshot.

Two caveats matter. First, OKB, the exchange token, sat at exactly 100% in the August 2026 report — no buffer at all, and platform tokens are usually the most volatile asset in the book, so a 100% ratio can get tight fast in an extreme move. Second, OKX has no publicly listed, on-chain-verifiable reimbursement fund of the kind Binance's SAFU provides (we break that comparison down in our Binance vs OKX vs Gate.io security comparison). Proof of reserves is a transparency tool, not insurance.

Licences: where OKX stands in 2026

Since the penalty, OKX has treated licensing as a long-term path rather than a talking point, and it is verifiable:

JurisdictionEntity and licenceDate
European UnionOKX Europe Limited — full MiCA CASP licence from Malta's MFSA (passporting across 30 EEA states); plus a MiFID II derivatives permission and a payment institution licenceMiCA 2025-01-27; MiFID II 2025-03; PI 2026-02
UAEOKX Middle East Fintech FZE — VASP licence from Dubai's VARA (described as the first global exchange cleared to offer retail derivatives)2024
SingaporeOKX SG Pte. Ltd. — Major Payment Institution licence from the Monetary Authority of SingaporeFull licence 2024-09
AustraliaOKX Australia — registered digital currency exchange with ASIC (derivatives limited to institutional and wholesale clients)2025
United StatesOKX INC / OKCoin USA — state licences plus FinCEN money services business registration; US customers onlyRelaunched 2025-04
SeychellesAux Cayes FinTech Co. Ltd. — global platform operator, no local VASP licence—

Read it carefully: the licences belong to separate local entities, not to the Seychelles global platform. Which entity serves you, and which rulebook protects you, depends on your jurisdiction — "OKX has a MiCA licence" does not mean the OKX you use is EU-regulated. And OKX explicitly does not serve mainland China customers; circumventing that breaches its terms and leaves you without recourse if the account is restricted.

What real users complain about

  • Risk-control holds and extra withdrawal checks. Accounts can be temporarily restricted and withdrawals may require extra source-of-funds or identity checks; community posts about "OKX froze my account" are common. From an AML standpoint this is a necessary step and a poor experience at the same time — but it counts in favour of fund security, not against it.
  • Support queues. Slow responses at peak times, a standard top-tier complaint rather than a red flag.
  • The Web3 wallet and DEX are a user-responsibility zone. On-chain approvals, seed phrases and third-party bots are not reimbursed by the platform. Complaints that lump these together with exchange custody usually miss the boundary between custodial and self-custodial.

The key point: none of the complaints allege a runway or misappropriation of user assets — a completely different category from FTX.

Who it suits, who it does not

Suits: futures and options traders, and advanced users who want to run an exchange and a Web3 wallet from one app; European users who value an EU licence and euro funding. Does not suit: pure spot buyers whose first priority is zero fees; compliance purists; mainland China users.

If you only want one or two venues, the usual combination is to keep the bulk of your capital on the deepest venue, Binance, use OKX for futures and Web3, and use Gate for small-cap listings. Where funds allow, do not put everything in one basket.

If you decide to use it, these settings are not optional

  1. Turn on Google Authenticator (2FA). Never rely on SMS alone — SIM-swap cases are real, and 2FA should gate both login and withdrawal;
  2. Set an anti-phishing code. Official emails carry your personal marker; treat any email without it as phishing;
  3. Enable a withdrawal address whitelist. Once on, funds can only go to pre-registered addresses, so a compromised account cannot drain to an attacker's new address;
  4. Minimise API permissions. If you only run a bot, disable withdrawal rights, bind a fixed IP, and delete unused keys immediately;
  5. Test small first. Make the first deposit and withdrawal small, confirm the route works, then scale up;
  6. Separate custodial from self-custodial. Keep only what you are actively trading on the exchange and consider self-custody for long-term holdings; anyone who DMs you as "support" or a "trading mentor" is a scammer.

FAQ

Is OKX safe, and is it safer than Binance?

On asset security the two are broadly the same tier: both publish monthly proof of reserves, hold the bulk of assets in cold storage, and have no loss-causing breach. Two differences: Binance has the SAFU reimbursement fund and greater scale and licensing breadth; OKX absorbed a roughly $505 million compliance penalty in 2025, having started its licensing push later but catching up quickly. Broadly, keep the bulk on Binance and use OKX for futures and Web3.

Could US regulators shut OKX down?

No. The fine is paid and the guilty plea is closed, so the risk has been crystallised and cleared; relaunching the US platform under a licensed entity shows compliance is a long-term strategy, not a box-tick.

Are OKX withdrawals safe?

On-chain withdrawals are backed by the PoR and cold/hot wallet model. Most "withdrawal not arrived" cases fall into three buckets — wrong network, whitelist not yet active, or risk review — and we walk through the fixes in OKX withdrawal not arriving. Same rule as always: test small first.

Can I use OKX from mainland China?

No. OKX does not serve mainland China users and blocks them at registration and KYC. Circumventing that breaches the user agreement and leaves you without recourse if the account is restricted — not worth trying.

Is OKX's proof of reserves real, and can I verify it myself?

Yes, you can: the official PoR page publishes each period's Merkle root hash and on-chain cold-wallet attestations, and a user-side verifier lets you confirm your balance was included in the snapshot. Understand the limits: PoR only proves that at the moment of the snapshot assets covered liabilities. It is not a promise about the future, and it is neither insurance nor a reimbursement guarantee.

How should I configure OKX account security?

The minimum is the trio of 2FA, an anti-phishing code and a withdrawal whitelist; a step-by-step walkthrough is in our OKX account security guide.
